Muslim women stage a march against terrorism in Agra

Hundreds of Muslim women took to streets in Agra on Sunday against the terror menace.

The rally was a part of the three-day National Women Muslim Conference, which concluded at Mathur Vaishya Bhavan in Agra.

carrying banners and placards with messages against terrorism, the participant said that the aim of this march is to create awareness among women especially Muslim women against the terror menace.

Shahzad Khan, organiser of the event, said that this was a three-day campaign to create awareness among the educationally backward sections of the society.

"This campaign was to create awareness among the Muslims who are educationally backward. National Muslim Front has begun this door-to-door campaign today along with Muslim women to guide children towards education," said Khan.

Here we will dive into a dark and closed universe; a universe where women are forced to commit to lifelong sexual relationships with close family members, where abuse of women is seemingly extremely widespread, where girls and women are forced to hide their female beauty behind veils, long unflattering coats, burkas etc., where men are free to rape women, because women are often automatically seen as the ones at fault.

In the article ‘A Question of Honor’ in The Independent on February 10th 2009, British police were quoted estimating that nearly 17,000 women in Great Britain fall victim to honour related assaults, including rape and forced marriage, every year.

Vibe Klarup Voetmann, director of the Copenhagen women’s refuge Dannerhuset, said to the Danish daily Kristeligt Dagblad on the 11th of June 2008 that 70 percent of the nearly 1.400 women who contact the centre each year come from a Middle-Eastern background. As ‘Dannerhuset’ is just one of 40 women’s refuges in Denmark, there is reason to fear that the number of Muslim women who seek shelter or counselling due to forced marriages, domestic violence or sexual abuse, is actually much higher. It is also worth taking into consideration the fact that many Muslim women keep quiet about assaults out of fear of retaliation from the family. Thus, in Denmark alone, the number of Muslim women who are abused each year is likely to exceed several thousand.

Islamic Feminism as an Emancipator for Muslim Women

Q: In recent years, a number of Muslim women’s groups have emerged across the world, struggling for gender equality and justice using Islamic arguments. Most of them are led by women who come from elitist or, at least middle class, backgrounds. Many of them seem to lack a strong popular base. How do you account for this?

A: I think the majority of the women who are writing and publishing about what is popularly called ‘Islamic feminism’ are definitely from the elite or the middle class. But then, globally speaking, feminism has always had to do with the middle class, at least in terms of its key articulators and leaders. I believe that Islamic feminism is, in a sense, the unwanted child of ‘political Islam’. It was ‘political Islam’ that actually politicized the whole issue of gender and Muslim women’s rights. The slogan ‘back to the Shariah’ so forcefully pressed by advocates of ‘political Islam’ in practice meant seeking to return to the classical texts on fiqh or Muslim jurisprudence and doing away with various laws advantageous to women that had no sanction in the Islamists’ literalist understanding of Islam. Translated into practice, law and public policy, this meant going back to pre-modern interpretations of Shariah, with all their restrictive laws about and for women. It was this that led, as a reaction, to the emergence of Islamic feminism, critiquing the Islamists for conflating Islam and the Shariah with undistilled patriarchy and for claiming that patriarchal rule was divinely mandated. These Muslim women were confronted with horrific laws that Islamists sought to impose in the name of Islam, and so began asking where in all of this was the justice and equality that their own understanding of the Quran led them to believe was central to Islam. These gender activists, using Islamic arguments to critique and challenge the Islamists, brought classical fiqh and tafsir texts to public scrutiny and made them a subject of public debate and discussion, articulating alternative, gender-friendly understandings, indeed visions, of Islam. That marked the broadening, in terms of class, of the fledgling Islamic feminist movement.

The areas of body which are to be covered by women in public, are mentioned in 24:31. Allah informs us through His messenger:

"And say to the Believing Women,to lower their gaze and guard their private parts. And they should not display their adornment save what is apparent therefrom. And they should place their covers over their bossoms. And they should not display their adornment except to their husbands or their fathers or the fathers of their husbands or their sons or the sons of their husbands or their brothers or their brother's sons or sister's sons` or their women or those whom their right hands posses or Those under their authority other than skillfull men or small children who are not aware of women's nakedness. And they should not strike their feet so as to make known what they hide of their adornment. O Believers turn you all together to Allah so that you may be successful."(24:31)

In all the debate about Afghanistan, we don’t hear much about our obligation to the wretched lives of Afghan women. They are being treated as collateral damage as the big boys discuss geopolitical goals. No, we can’t go around saving every failed state, but as well as clear national security interest, there’s a moral obligation here that is being forgotten.

More than a million Afghan men died fighting our proxy war against the Soviets. The streets of Kabul today are full of sightless beggars and amputees who paid the price for that nine-year struggle. America funded the Islamic revival, giving out Korans and Stinger missiles to beat the Communists, then pulled out and was surprised when the assassins of 9/11 were spawned by the chaos left behind.

The women of Afghanistan, left behind as their men fought, did what the women of World War II did—used their wits and resourcefulness to preserve some semblance of civilization. The Taliban’s backward vision of a radical Islamist state was a utopian fantasy. Except in the rural villages of the south, women before the Taliban worked as doctors, judges, teachers, broadcasters, and budding politicians.

Now Afghan women are terrified we will abandon them again. Anne McBride, who observed the elections last month, emailed me: “The women I met at polling stations risked their lives to come out and vote, but they are angry that the Taliban ruined their lives and are willing to risk it. They are not tolerant of half-steps for women.” Are we really considering throwing them back into the dark, leaving them even more vulnerable after their return to freedom?

KARACHI: If a Karachi police surgeon is to be believed, on an average 100 rapes take place in the port city of Karachi alone, and mostly working women are the victims.

He said because of the "lengthy medical process and delayed justice system in Pakistan", only 0.5% of rape cases are reported to the police.

"On average, 100 women are raped every 24 hours in Karachi city alone, and a majority of them are working women. I am saying with full authority that such a large number of rape cases happen in the city. But very few rape survivors have the courage to come forward in search of justice," Additional Police Surgeon Zulfiqar Siyal said on Monday.

He added that a majority of the victims working as domestic help.

According to the information that I have received, those three women openly discussed the killings, spoke against the tribal customs and protested against the live burial of five women taking place in the same province. They were also buried alive using the same tractor as in the case of the five women, after being allegedly abducted by Mr.

Abdul Sattaar Umrani--the younger brother of the provincial minister--and other thugs, including a head constable of police, who are also main perpetrators of the earlier five women's burial case.

It looks to me as if power politics in the area are directly challenging the written orders of the courts on killing and burying women. The government's adherence to self-serving means has afforded the wrongdoers additional space in which to perpetrate atrocities and act with impunity.

Some Saudi scholars have recommended such a move, others agree but prefer this with restrictions to issuing fatwas (religious edicts) only for women. While some others don’t approve it at all.

Hassoun has said he is personally supervising a project that would make women ready to become muftis soon in Syria.

According to him, tens of women of varying ages, who graduated from Islamic law school, are now enrolling in different courses that would help them issue fatwas in matter relating to women. Women who become ‘muftiya, can also be members of the Iftaa Board.

Syrian women scholars welcomed the announcement and Huda Habsh, a Syrian scholar who spoke to an Arabic online news agency, said that this is a ‘positive’ move.

What may seem different here is the fact that both the bride and the groom are sitting across the table from each other, and not behind a veil or curtain as in most Muslim weddings. But what really sets this wedding of Lucknow’s Naish Hasan and New Delhi’s Imran Ali apart is the fact that the nikah was performed by a woman.

Ushering in a new trend and breaking all traditional barriers, the wedding of two eminent social activists working for the rights of Muslim women was performed by eminent scholar and member of the Union Planning Commission Dr Syeda Hameed. Dr Hameed flew in from Delhi especially to perform the nikah and bless the couple. Although there has been no precedent of women conducting a nikah in recent history, women are known to have attained the position of qazi and mufti in times of the Prophet.

“I always wanted a wedding which did follow the proper guidelines of Islam and the Shariat but gave equal rights to Muslim women. The model nikahnama has been supporting Muslim women by giving them rights and I wanted my wedding to be according to it,” said Naish, founder member of the Bhartiya Muslim Mahila Andolan (BMMA), a social organisation.

In the past too, several persons arrested for having terrorist links have lived in Naya Nagar, said sources.While Naya Nagar is now under the police scanner, the residents have undertaken a social combing operation to flesh out those with terrorist links. The chairmen and secretaries of the over 400 housing societies in Naya Nagar have been asked to check the credentials of those purchasing flats or living on rent.The 27 masjids located in Mira Road and Bhayandar areas have for the past few days been asking their members to keep a vigil in and around their locality. The imams of all these masjids have personally written letters to their members informing them about the initiative. "People have welcomed the move. No one wants to be seen as encouraging terrorists. Naya Nagar, especially, has got a bad name due to the arrest of few accused having terrorist links,'' said Imam Maulana Mansoor Ahmed of Sham's masjid.The telephone numbers of the mosques' Imams and that of the local police stations have also been displayed at these mosques. At Naya Nagar , a team of women residents has been visiting homes where women live alone. "At least in case of 25% of families in Naya Nagar, the men are out of the city or country.

It’s a bit startling nevertheless to walk into an upmarket shop near Bab Touma (the ‘Gate of Thomas’, but earlier the ‘Gate of Venus’) in the Christian quarter to look closer at lovely walking socks and discover inside that buying lingerie is something of a feminine pastime in Syria. Moreover, Syrian girls, like Indian girls, have to be married, and a bride must be equipped with at least 25 to 30 kinds on her wedding night, according to one young lady, or her groom may think she is not trying enough to please him. Despite their apparent freedom in dress, right-to-work and education compared to women in other Muslim-majority countries that we’ve seen or heard about, I got the impression that many Syrian women like other women of the Sharq (East) were firmly under the patriarchal thumb in their personal lives. (One Muslim girl wept quietly that her family wouldn’t let her marry her Christian boyfriend – so like in India).

Al-Harithi said female guards are trained on the job as per plans drawn by a department for training and rehabilitating prison officials. “They are trained to deal with all eventualities.” Women officials in women's prisons arrange guard shifts, supervise rehabilitation programs for inmates, escort inmates who have to appear in court or other government departments, and they arrange for conjugal visits.

Women prison officials’ military ranks are currently limited to private and noncommissioned officer, he said, adding that there are plans to expand women’s work and duties in prisons. Women who apply for a job as a military officer must be a Saudi, have a secondary school certificate, have no criminal record and be at least 17 years old.

Indian Muslim women deserve congratulations for their new marriage code

Indian Muslim women deserve congratulations for coming out with their own marriage code. The All India Muslim Personal Law Board (AIMPLB) is using its clout in the media to denigrate this move. But they have yet to come out with a coherent answer to the question: after all, what is wrong or un-Islamic about the new women’s proposed code. Before criticising the women board’s effort and calling it irrelevant and useless and so on, they should come out with cogent explanations of what is wrong with it.

Our experience with ulema is not very encouraging. I am certain that if someone were to go to the ulema, at least in Phulwari Sharif, Patna, of which I have some experience, and say I dreamt of having divorced my wife thrice in one go, they would say that he is now divorced and if he wants to live with his wife now he should hand over his wife to an aalim or someone else for the dastardly practice of halala. I know of a case where a woman had been divorced during pregnancy and though there is a provision in Islamic law that such a divorce should not take effect unless the husband were to feel the same way and repeat his pronouncement even after the birth of the child, the ulema pronounced divorce as legal as per their habit. The practice of ulema’s ruling in the case of Muslim family dispute is indeed quite ridiculous. Their fatwas could indeed be termed hilarious, if they were not so dangerous. In fact any one with a modicum of sense of humour who wants to have a good laugh can do nothing better than sit down with a voluminous book of fatwas pronounced by ulema on a variety of subjects, ranging from the ludicrous - whether one should put one’s left or right foot forward first while going to the loo – to the relevant disputes in family lives that can rebuild or destroy people’s lives.

I do not have a copy of the new or old nikahnama and cannot form a very well-informed opinion in the matter. But from the reports in the media, the new one looks quite formidable and commendable and need of the hour.

The following points have been made in media reports. I am citing them below to keep them on record:

Daring the ulema and orthodox Muslims, the All India Muslim Women

Personal Law Board in its "Shariat Nikahnama" released on Sunday, March 16, 2008, has come up with a host of measures that ensures that Muslim women get their right. Not only does it recognise the right of women to seek divorce (khhula) and separation, it ensures financial settlement with an eye to the welfare of the woman and her children, advises registration of marriages and forbids forceful marriages.

The new code also rejects talaq through SMS, e-mail, phone and video conferencing. Talaq on provocation will not be considered either.

According to it, talaq to be valid should be spread over three months to give the couple ample time to reconsider the issue. "We are not scared of the mullah, but the Allah," said Shaista Amber, chairperson of the AIMWPLB. "The mullahs will never come to the rescue of destitute women. Why should the Muslim woman be scared to seek khhula when this right has been provided to her by the Allah?"

The new Nikahnama has a 17-point Hidayatnama (guidlines for marriage under the Shariat law for bride and groom) and an 8-point section on the process of talaq. The Hidayatnama declares that any forceful nikah is not acceptable. Forceful dowry has also been forbidden. Amber said the new "Shariat Nikahnama" was very different from the model Nikahnama of the All India Muslim Personal Law Board (AIMPLB).

"The model Nikahnama had not taken care of the women's rights as per the Koran. The new Nikahnama maintains the equilibrium," she said. While the model Nikahnama is in Urdu, Shariat Nikahnama is available both in Hindi and Urdu so it reaches more people. Ms. Amber said it had been prepared in Urdu and Hindi so that the common people could understand the “rights and responsibilities of the husband and wife.” She said it had “three forms of which one is for registration of the ‘nikah’ at the Registrar of Marriages. The other two are for the Qazi, who solemnises the marriage, and for the bride and the groom.”

"The woman has full authority to seek khhula under Shariat law, from her husband if the husband harasses her and her children," said Amber.

She claimed that the “Shariat nikahnama” was better in many ways as “its language is easy and it contains the rights of women.” “In the old ‘nikahnama,’ there is no provision for address verification; registration of marriages has not been made compulsory and the rights of women have not been clearly laid down. Besides, it is in Urdu and everyone cannot understand it properly,” Ms. Amber said.

The woman must approach the Darul Kaza (a Shariat court) for seeking divorce under khhula. In case of talaq, all gifts received during the marriage and afterwards will be the property of the bride. In absence of a divorce, the Nikahnama says any woman can go for separation if the husband is missing for four years, has an illicit relationship with another woman or refused to disclose HIV status before or after marriage. Besides, issues like not providing food, clothes and other essentials will also be counted as grounds for separation. In case of separation, the woman has the right to mehar.

To avoid controversy, the new Nikahnama also rules that three forms should be filled in during nikah - one each for the marriage bureau, the bride and groom and the quazi. Muslim women had criticised the model Nikahnama of the AIMPLB, released in 2005, saying it failed to address the contentious issue of "triple talaq".

Unveiling the new Muslim Marriage Act drafted by a 30-member executive body, AIMWPLB chairperson Shaista Amber told a news conference in Lucknow, U. P. that it was an improvement on other ‘nikahnamas’ and “its authenticity cannot be challenged” as every provision was in accordance with the Shariat and it quoted the Koran. She said it would mitigate the “agonies and sufferings of women” arising out of divorce and gives more rights to the wife.

Senior AIMPLB member Maulana Khalid Rasheed Firangimahali termed the new nikahnama useless and irrelevant. He said “already there is a nikahnama issued by the AIMPLB, there is no room for another one.” He said the old one was as per the Koran and Shariat and was in practice. On the compulsory registration of the Muslim marriages, he told PTI that the Board had already made it clear that it would support this only when some conditions were fulfilled. “We have said marriages should not be held invalid in the absence of registration. Besides, the ulema solemnising the marriages could be given the powers of the registrar of marriages for the purpose of registration,” Maulana Firangimahali said.
