Islamic State’s Genocidal Campaign Against Yazidis Will Prevail Until The Full Scope Of Islamic State Crimes Are Unearthed And Justice Is Delivered

Five years ago, Islamic State fighters invaded my ancestral homeland of Sinjar, Iraq, and waged a systematic ethnic-cleansing campaign against the Yazidi community. Their campaign included mass executions, forced religious conversions and widespread sexual violence. These attacks resulted in the massacre of Yazidi men, women and children; the enslavement of nearly 7,000 Yazidis; and displacement of more than 400,000 Yazidis to camps in northern Iraq.
But that was not the end of our suffering. As Sheri P. Rosenberg observed in a 2012 article, genocide is a process, not an event. The continued suffering, fear and uncertainty in the Yazidi community show that the genocide process is ongoing. About 350,000 Yazidis remain trapped in camps in northern Iraq. Yazidis in these camps live in weather-worn tents without adequate access to food, water, electricity, education or opportunities to work. They also lack basic health care, including psychological support to aid in trauma recovery.
An estimated 3,000 abducted Yazidi women and children are still missing, with fears that some might have been sold to al-Qaeda affiliates — women and girls to be sex slaves, boys to be trained as fighters. Others may have been forcibly relocated to cities in other countries or have become collateral damage in military offensives in the region. Though thousands of Yazidis have sought asylum in Europe and elsewhere, foreign governments are approving fewer and fewer asylum claims, making it more difficult for Yazidis to seek safety.
But the Yazidi people are not without hope. We want justice, we want to rebuild, and we want to go home — but we cannot do so without support. As we approach the fifth anniversary of the Yazidi genocide on Aug. 3, I call on the international community to undertake concrete actions to support the repatriation of Yazidis.
In my recent speech at the State Department’s Ministerial to Advance Religious Freedom, I outlined the necessary steps for the successful return and rehabilitation of the Yazidi community. These include resolving Sinjar’s local governance issues, investing in long-term sustainable development initiatives, recruiting Yazidis into Iraq’s official security forces and prosecuting the Islamic State for war crimes. These steps are not only crucial to helping the Yazidis recover from the genocide but can also promote the rebuilding of trust among the different communities in Iraq, ultimately supporting the process of peace and reconciliation in the region.
While we estimate that 80,000 Yazidis have returned to Sinjar, local conflicts complicate survival. The Islamic State’s collapse created a power vacuum, opening the door for competing groups that occupy some portion of Sinjar but do not have complete control. The situation is further complicated because of disagreements between Baghdad and Irbil over governance and security in Sinjar. The Yazidi people cannot return to their homeland when security risks remain high. They must be given a voice, both in governance and over security decisions.
As factions vie for strategic dominance, our community also suffers from a lack of infrastructure. Investment in sustainable development initiatives in the Yazidi homeland is vital. Funds are needed for rebuilding homes and public facilities, such as hospitals and schools. According to the United Nations Development Program’s Funding Facility for Stabilization 2018 Q3 Report, more than 90 percent of recovery projects in the region are underfunded, and the funding has decreased by 41 percent since 2017. The UNDP identifies this gap as the most significant challenge to stabilizing the area, and international support is crucial for meeting these needs.
Finally, the Yazidi people deserve justice for the atrocities committed against them. This year, Sweden called for support from European allies to establish an international Iraq-based war crimes tribunal, modelled after the International Criminal Tribunals in Rwanda and the former Yugoslavia, to prosecute Islamic State fighters. The Syrian Accountability Project’s Report on the Yazidi Genocide recommends an international effort to preserve the physical evidence of Islamic State crimes, including archival documentation of Yazidi survivors and their stories and protection of forensic evidence such as mass graves. Moreover, the international community can help the Iraqi government locate the still missing Yazidis or record their fate. Until the full scope of Islamic State crimes are unearthed and justice is delivered, our people will continue to suffer.
The international community fought to defeat the Islamic State — but the job is not done. Abandoning the Yazidis to a war-torn land and uncertain future allows the seeds of further violence to take root. If the international community refuses to exchange platitudes for swift action, the Islamic State’s genocidal campaign against Yazidis will prevail.

Notwithstanding what Shah has said, the Presidential Order doesn’t scrap Article 370 in so many words.
It expressly supersedes the Constitutional Order which brought in Article 35A.
It effectively revokes Article 370 because it says that all provisions of the Constitution apply to Jammu & Kashmir.
It opens the door to repeal of Article 370 by modifying the wording of Article 370(3) so that the Legislative Assembly of J&K can give approval to remove Article 370.

Pak Army Denies Indian Claim of Cross-LOC Incursion

Similarly, the Foreign Office also issued a statement at about mid-night to reject the claims by India.

Army Foils Pak Infiltration Bid in J&K’s Keran, At Least 5 Intruders Killed
The Indian Army on Saturday, 3 August said that in the last 36 hours, it had foiled an attack by Pakistan's Border Action Team (BAT) on a forward post along the Line of Control (LoC), in Jammu and Kashmir’s Keran sector. In the process, it killed at least five to seven intruders, a defence spokesman in Srinagar said, as per PTI.
The BAT generally comprises special forces personnel of the Pakistani Army.

A senior police officer dismissed on Saturday the rumours that Jammu and Kashmir Police personnel were being asked to deposit their weapons, and asserted that strict action would be taken against people behind them.
"The tweet...in which it has been mentioned that J&K policemen are being asked to deposit their weapons and CRPF and Army were taking control of police stations, is a criminal rumour," Additional Director General of Police (Law and Order) Muneer Khan said.
"Strict action will be taken against these criminal elements who have spread these malicious rumours with intent to vitiate the atmosphere. We are trying to find out who has initiated this malicious rumour," Khan said in a statement.

Tourists, Pilgrims Leave Valley in Wake of J&K Advisory
Tourists and Amarnath Yatra pilgrims started to leave the Kashmir Valley on Saturday in the wake of the advisory asking them to cut short their stay citing security threats.
An official at Srinagar Airport said Indian Air Force (IAF) flights have been pressed into service "as per requirement".
Jammu and Kashmir Tourism Department sent buses on Friday, immediately after the advisory was issued, to different tourist destinations to bring the tourists back to Srinagar, director, Tourism Kashmir, Nissar Wani, said here.
He said about 20,000-22,000 tourists were in Kashmir on Friday.
"While most of them have reached Srinagar or have left the Valley, some of them are still staying. Few tourists had gone trekking in Pahalgam area and have not yet returned to their bases. Once they return, we will tell them to leave," Wani told PTI on Saturday.
"We sent buses to Gulmarg, Pahalgam and other spots to bring the tourists to Srinagar and facilitate them in leaving the Valley. This went on till late into the night and I was myself monitoring the situation," he said.

Airports Authority of India said in a statement that 6,126 passengers were reported at Srinagar Airport on Saturday for travelling out of Valley. The Civil Aviation Ministry on Saturday advised airlines to keep fares from Srinagar in check as Amarnath pilgrims and tourists rushed to the airport after the Jammu and Kashmir administration asked them to curtail their stay in the state.
"The Ministry of Civil Aviation has advised the airlines to rein in the surging ticket prices - on flights coming out of Srinagar - for yatris returning from the Amarnath dham," a source told PTI.

Congress Leader Digvijaya Singh Warns Centre on 'Forceful Move' in Kashmir
Senior Congress leader Digvijaya Singh said on Saturday that the BJP should tread carefully in the restive Jammu and Kashmir.
"Have the heavens fallen that you (Centre) have called off the Amarnath yatra? A force of 20,000 (troopers) has been sent there (J-K). It is an indication of a big exercise," he told reporters.
"But the BJP (government) should keep in mind the Valley's sensitivity and work thoughtfully. If they move ahead forcefully, there is a possibility that the country could suffer massively," Singh claimed.
The senior Congress leader went on to add that the security advisory to Amarnath yatris and tourists inconvenienced lakhs of pilgrims.
"I don't have faith in this government (Centre). I have not seen a bigger liar than this government. We are seeing acts committed by terrorists daily," he alleged.

The Jammu and Kashmir Pradesh Congress Committee (JKPCC) on Saturday expressed concern over the situation in the state and sought clarification from the Centre to end the “uncertainty" in the valley,” according to PTI.

Addressing the media, Senior Congress leader Ghulam Nabi Azad said that the central government’s advisory on suspension of the Amarnath Yatra is worrisome and that it has instilled fear among people in the Valley.
“During the BJP-backed government in 1989, Kashmiri Pandits were expelled from everywhere, which till today is a stigma. Today, 30 years later, the same situation is before us. This is not good for Jammu and Kashmir,” Azad said.

VHP Cancels Upcoming Budha Amarnath Pilgrimage in J&K
The Vishwa Hindu Parishad on Saturday announced cancellation of the upcoming annual Budha Amarnath yatra, citing threat posed by Pakistan-sponsored terrorists to the pilgrimage.
The 10-day yatra in Poonch district of Jammu region, organised by the VHP, was scheduled to begin on 6 August.
"In view of the emerging security situation following the recovery of US made sniper rifle and landmine along the Amarnath yatra track in Kashmir, we have decided to cancel the yatra to Budha Amarnath for the safety of the pilgrims," State VHP president Leela Karan Sharma told reporters in jammu.

Machail Yatra to Goddess Durga Shrine Suspended
Machail Yatra to Goddess Durga’s shrine in the Kishtwar district of Jammu and Kashmir has been suspended, reported ANI, quoting District Commissioner Angrez Singh Rana.
“The yatra has been suspended with immediate effect due to security reasons,” Rana told PTI.
The yatra commenced on 25 July and was scheduled to end on 5 September.
Thousands of devotees from across the country visit the scenic Paddar valley, also famous for its sapphire mines, during the yatra and pay obeisance at the holy shrine of goddess Durga in Machail village of Kishtwar after trekking a 30-km arduous route.

Air India, on Friday, said on Twitter that in view of the prevailing situation in Jammu and Kashmir, it will give a full fee waiver on rescheduling or cancellation for all flights to or from Srinagar till 15 August.

DGCA Advises Airlines to Be Ready to Operate Extra Flights from Srinagar
With situation appearing turbulent in Kashmir, aviation regulator DGCA advised airlines on Friday to remain ready to operate additional flights from the Srinagar airport if the need arises.
“DGCA has advised airlines to remain ready. If there is a need, airlines should be ready to run extra flights,” a source privy to the development told news agency PTI.
“Around 8:45 pm, the situation at the Srinagar airport was checked by the DGCA and it was found to be normal. It was found that there is no need to run extra flights right now. But if the need arises later on, the airlines have been advised to remain ready to run extra flights,” the source reportedly said.

Congress Urges Govt Not to Precipitate Crisis in J&K
The Congress on Friday urged the government not to take any decision that would precipitate a crisis in Jammu and Kashmir and asked it to ensure the constitutional guarantees given to the state are maintained.
The appeal to the government came after a Congress policy planning group on Jammu and Kashmir met under the chairmanship of former prime minister Manmohan Singh, according to PTI.

‘Terrorists Planning to Target Amarnath Yatra’: J&K Govt Tells Pilgrims, Tourists to Leave Valley
Pakistan-based terrorists are planning to target the ongoing Amarnath Yatra, the army said on Friday, 2 August, citing intelligence inputs, prompting the Jammu and Kashmir administration to ask the yatris and tourists to "curtail" their stay in the Valley and leave immediately.
Stating that weapons and explosives have been recovered along the yatra route, a top army official said security forces are geared up to foil any attempt to attack the pilgrimage, news agency PTI reported.
"Last three to four days, we were getting specific and confirmed intelligence inputs that terrorists led by Pakistan and Pakistan Army are trying to target the Shri Amarnathji yatra which is going on," General Officer Commanding (GoC) of Army's 15 Corps Lt General KJS Dhillon told a joint press conference with state police chief Dilbagh Singh in Srinagar.
Following the joint briefing, Governor's administration issued a security advisory, saying pilgrims and tourists "may curtail their stay" and "return as soon as possible".

What Does Islam Say About Keeping The Covenant Of Living Peacefully Under Any Democratic Constitution?

Islam strongly emphasizes fulfilment of Covenant (Ahad). It teaches that even if a person is in a severe state of hardship, he should maintain his covenant. Islam strictly prohibits Muslims from breaking promise. Islam substantiates that the one who breaks promise earns displeasure of Allah and will deserve punishment.
Allah Almighty says in the Quran,
 “But yes, whoever fulfils his covenant and fears Allah - then indeed, Allah loves those who fear Him. Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price will have no share in the Hereafter, and Allah will not speak to them or look at them on the Day of Resurrection, nor will He purify them; and they will have a painful punishment.” (3:76-77)
In the above-mentioned verse, having condemned those who break the Covenant, Allah Almighty admires those who fulfil the Covenant. This verse emphasizes that the person who fulfilled the covenant and feared Allah is beloved by Allah.
The Commentators of the Quran have described the virtue of fulfilling the covenant this way that the obedience to Allah Almighty depends on two things; (1) reverence for Allah Almighty and (2) affection for the creatures. Both are included in the meaning of fulfilling the covenant. Allah has commanded the fulfilment of the covenant. Thus fulfilling the covenant is obedience to His command and great reverence for God. Fulfilment of the covenant benefits the creature. Therefore there is not only reverence for Allah but also affection for the creatures. This can also be said that whoever fulfils the covenant of the creatures will also fulfil the covenant of Allah. The covenant of the slaves towards Allah is that he should worship Him alone, obey all His commands, and abstain from all the acts that Allah has forbidden. If the human beings fulfil the covenant of God and His servants, he will become perfect devotee (muttaqi) and these are the people whom Allah loves.
Allah says in the next verse: “Those who sell out God's covenant and their oaths for a paltry price will have no share in the life to come on the Day of Resurrection. God will neither speak to them nor cast a look upon them on the Day of Judgement, nor will He purify them. For them there shall be a grievous punishment”. (3:77) 
Allah says,
“When you speak, observe justice, even though it concerns a close relative; and fulfil the covenants of God. That is what He has enjoined upon you so that you may take heed”. (6:152)
He also says,
“As for those who have honoured the treaty that you made with them and who have not supported anyone against you: fulfil your agreement with them to the end of their term. God loves those who are righteous.” (9:4)
It has been known through the afore-mentioned verses of the Quran that Islam strictly prohibits from breaking the covenant. This is mentioned not only in the Quran, but the preacher of Islam the Prophet (peace be upon him) has also presented an exemplary character of fulfilling the covenant. The following incident is one of many examples.
When the pagans of Makkah were more in number during the Battle of Badr, Hazrat Huzaifa bin Yaman and his father Abu Haseel set out for joining the Muslim army. On the way some disbelievers stopped them and asked if they were heading for Badr to support the Prophet (peace be upon him). They replied in negative and promised not to assist the Muslim army and were later let go by the disbelievers. Then they reached the Muslim army and told the Prophet (peace be upon him) about the incident taking place on the way. The Prophet separated both of them from the battle-line and said, “We always fulfil our promises, not matter what the circumstance. We need the help of Allah Almighty alone and He is Sufficient as a Helper” (Sahih Muslim)
We find many such events in the books of history and traditions that Muslims and the rightly guided caliphs (Khulafa-e-Rashidin) did not break the covenant. But today the situation has turned. Not only do the people break the covenant for their own benefit, but they also oppress others. One person says something and others something else. They break their promises momentarily. However Islam teaches that once a person has made covenant, it is compulsory for him to fulfil it, no matter he may have to bear the big loss. From there it can be concluded that anyone who has made covenant to live peacefully under a democratic law in a country, he must fulfil it, whatever the case may be.

अक्टूबर १९४७ ई० में कश्मीर के महाराजा को कश्मीर का भारत से सहबद्ध करना पड़ा था वहाँ की जनता तीन वर्गों में बट गईl एक वर्ग आज़ाद राज्य, दोसरा वर्ग पाकिस्तान के साथ एकीकरण और तीसरा वर्ग भारत के साथ सहबद्धता का इच्छुक थाl सच बात तो यह है कि उस समय से ले कर आज तक कश्मीर इनही तीन वर्गों में बटा हुआ हैl मेरी बात का सबूत है कि आज़ादी, अलगाव और पाकिस्तान से एकीकरण के बारे में सभी आतंकवादी घटनाएं हिंसक प्रदर्शन कश्मीर के केवल आठ नौ शहरों तक ही सीमित रहे हैंl आपने ना तो कभी करगिल में हंगामे की बात सुनी होगीl ना आप ने लद्दाख में कभी किसी प्रकार की शोरिश देखी होगी और ना ही जम्मू रीजन के किसी क्षेत्र में फ़ौज पर पत्थर बाज़ी करते हुए किसी मुस्लिम युवक को देखा होगाl आपने यह भी कभी नहीं सूना होगा कि कठुआ, पुंछ, राजौरी, और डोडा जैसे क्षेत्रों में भारत के खिलाफ कोई प्रदर्शन हुआ हो जब कि इनमें से कई स्थान मुस्लिम बहुल हैंl सभी प्रकार की हंगामा आराई श्रीनगर, बड़गाम, शोपियान, पुलवामा, अनन्त नाग, बारहमुला, कुलगाम, गान्दरबिल और बांडी पूरा तक ही सीमित रहती हैl इनही स्थानों को भारत विरोधी सरगर्मियों का केंद्र बना दिया गया है हालांकि वहाँ भी हज़ारों ऐसे लोग मौजूद हैं जो ना केवल प्रदर्शनों में शरीक होते हैं और ना ही अपने बच्चों को पत्थर बाज़ी करने की अनुमति देते हैं, यह वर्ग ऐसा है जो पाकिस्तान के साथ सहबद्ध के कल्पना को आत्महत्या के बराबर और आतंकवाद को हराम और इस्लाम की बदनामी का कारण समझता हैl इन क्षेत्रों में कश्मीरी आतंकवादियों ने हालात ऐसे बिगाड़े हैं कि आज आम कश्मीरी अपने बच्चों को मस्जिदों में भेजते हुए डरने लगे हैंl कुछ माह पहले मेरे एक दोस्त कश्मीर से आए तो बातों बातों में कह गए कि कश्मीर के हालात इतने खराब कर दिए गए हैं कि हम अपने बेटे को मस्जिद में नमाज़ पढ़ने के लिए अकेले नहीं भेज सकतेl हमको इस डर से साथ जाना पड़ता है कि कहीं बच्चे को अकेला पा कर आतंकवादियों का एजेंट गुमराह ना कर दे, कहीं पत्थर बाजों के गिरोह अपने साथ पथराव करने पर मजबूर ना कर दें और अगर उनसे हमारा बेटा बाख भी जाए तो कुछ अजब नहीं कि पुलिस वालों के हत्थे चढ़ जाएl यह बात सुन कर लगा कि कश्मीर के आम लोग हिंसा और आतंकवाद से खुद को अलग रखना चाहते हैं, मगर उनकी मदद करने वाला कोई नहीं हैl अफ़सोस की बात यह है कि हमारे देश का फिरका परस्त वर्ग और गुमराह करने वाला मीडिया ऐसे कश्मीरियों का दर्द समझने के बजाए सब पर आतंकवादी लेबल लगा देता हैl
भारत से प्यार रखने वाले मुसलमान कश्मीरियों को बिलकुल फ़रामोश करके वतन से वफादारी को केवल कश्मीरी पंडितों से जोड़ा जाना भी उसी तर्ज़ ए अमल का एक नमूना हैl कोई ऐसे मुसलमानों की हौसला अफजाई नहीं करता जो अलगाववाद की किसी तहरीक में शामिल नहीं होतेl कोई भी भारतीय राजनीतिज्ञ इन मुसलमानों की प्रशंसा में एक शब्द भी नहीं कहता, डोडा, कठुआ, राजौरी, पुंछ, लेह, लद्दाख और करगिल में भारतीय झंडे के साए में रहने को पसंद करते हैंl किसी को यह बात प्रशंसनीय नहीं लगती कि जम्मू व लद्दाख के मुस्लिम बहुल क्षेत्रों में मज़ाह्मती तहरीकें नहीं चलती या आतंकवादी घटनाएं नहीं होतींl अफ़सोस की बात यह है कि कश्मीर से भारत के सहबद्ध के हामी कश्मीरी मुसलमानों की हौसला अफजाई करने के बजाए फिरका परस्त मानसिकता वाले लोग उन पर भी पाकिस्तान का झंडा चढ़ा देते हैंl हर आदमी के खौफ की वजह से कश्मीर से भागने पर मजबूर हुए उनका कोई उल्लेख करने वाला नहीं? कश्मीरी पंडितों और सिखों पर आतंकवादियों ने जो हमले किये उनका हिसाब किताब तो सब के पास है, लेकिन जो कश्मीरी मुसलमान आतंकवादियों की गोलियों का निशाना बने उनकी लाशों पर रोने वाला कोई नहीं? भारतीय फ़ौज में शामिल कश्मीरी सिपाहियों और जम्मू व कश्मीर की पुलिस में शामिल मुस्लिम अहलकारों पर कैसे कैसे मज़ालिम दहशत गर्दों ने नहीं तोड़े मगर किसी फिरका किसी फिरका परस्त को उनकी कुर्बानियां याद करने का समय नहीं मिलताl कश्मीर के कब्रिस्तान आतंकवादियों के हाथों मरने वाले वतन परस्त मुसलमानों की कब्रों से पूरी तरह भर चुके हैंमगर जब भी कोई बात करता है वह कश्मीरी पंडितों पर अत्याचार का उल्लेख करता है वतन से प्यार करने के जुर्म में मौत की सज़ा पाने वाले कश्मीरी मुसलमानों का नहींl अर्थात केवल कुछ दहशत पसंद नहीं कुछ तथाकथित देशभक्त भी कश्मीर के मसले को हिन्दू और मुसलमान का झगड़ा बनाना चाहते हैं, जबकि हमारा मानना यह है कि कश्मीर का मसला हिन्दू मुस्लिम का नहीं, यह हिंदुस्तानियत और इंसानियत का मामला है, आतंकवादियों के हाथों जीतने अत्याचार पंडितों ने झेले हैं उतने ही कश्मीरी मुसलमानों ने भी सहे हैंl इसलिए जो लोग कश्मीर के मामले को फिरका परस्ती के चश्मे से देख रहे हैं वह इस देश को लाभ नहीं हानि पहुंचा रहे हैंl

When The Civil Society Fails To Root out Social Injustice To The Weaker Section, God Intervenes By Paving Ways For Legal Laws Against It

There is a lot of hue and cry over the Triple Talaq Prevention Bill passed by the BJP government. Muslim religious scholars and bodies call this an interference in the religious affairs of the Muslims. The government argues that the Triple Talaq is an injustice to Muslim women and so it has brought the Bill which has a provision of three years of imprisonment for the husband while the Muslim religious bodies hold that the Triple Talaq is approved by hadiths and Imams of Muslims. For a long time, feminist organisations of Muslims had been campaigning against Triple Talaq or instant Talaq. During recent years, some divorced women; victims of the practice of instant Talaq had moved courts of law pushing the government to bring the law on Triple Talaq.
Many Islamic scholars had already been campaigning against Triple Talaq with references from the Quran and also with references from the life of the holy prophet pbuh and the Sahaba. But the religious seminaries were adamant on their stand that the Triple Talaq had sanction from some imams and other religious scholars of the past. They present even some hadith in favour of their argument.
The Triple Talaq had been misused by illiterate men who were not aware of the rules of Talaq mentioned in the Q  uran. They only knew that their imams and muftis told that instant Triple Talaq was valid and permissible and so they divorced their wives at any pretext. In most of the cases, the husbands did not have justification for their action. Still, the muftis would tell them that since they spoke the word Talaq three times, the Talaq was valid and if they wanted to get their wife back they must go through halala. Therefore, the evil practice of halala was an offshoot of instant Triple Talaq. These two evils ruined the lives of millions of Muslim women. Statistics show that the incidence of divorce among Muslim women is twice the national average.
Unfortunately, even before the passing of the Bill, the religious scholars associated with Islamic seminaries did not show any change in their attitude and were not ready to bring reformation in Talaq laws. They were adamant on the validity of instant Talaq. This gave the government the scope to bring legislation on Triple Talaq. The holy companions showed flexibility in approach while dealing with the incidents of Talaq. The second caliph Hadhrat Umar had changed the law of divorce according to the contingency of the period to save married women from harassment. During the present period, when the instant Talaq is being misused rampantly ruining homes and lives of Muslim women, the ulema of the present day would also have done well to bring reforms by banning instant Triple Talaq. The Quran cleanly says: At-Talaqo Marratan (Talaq is for two times). (Al Baqarah: 229)
It means the husband will give Talaq twice at the prescribe periods and after Talaq on two separate occasions, the husband and wife should sit together and decide whether they still want to separate or get back. If they decide to reconcile, they should make amends and if they decide to get separated, they should do so with kindness. Here are the verses:
A divorce is only permissible twice: after that, the parties should either hold Together on equitable terms, or separate with kindness. (Al Baqarah:229)
But if their intention is firm for divorce, Allah heareth and knoweth all things.(Al Baqarah:227)
O Prophet! When ye do divorce women, divorce them at their prescribed periods, and count (accurately), their prescribed periods: (Al Talaq: 1)
The Quran at no occasion mentions Talaq thrice at one go. It advises both the husband and wife to make certain reconciliatory steps before making any decision. But here the conservative ulema have given the husband the tool of instant Talaq to illiterate and uneducated men to rampantly misuse it at the slightest pretext. And they present various flimsy arguments to justify the act. One argument is that killing a person with a sword is illegal and impermissible, but if a person kills his wife with a sword, he cannot say that he did not want to kill his wife, and the wife will not come alive because of his saying so. Similarly, if a man gives three Talaqs to his wife, the Talaq has occurred even if this form of Talaq is unwanted. But they ulema ignore the fact that killing the wife and divorcing the wife are not similar incidents. After a divorce, the wife is alive and can be taken back. The counter argument against their argument is that when a man is fasting and he eats to the full stomach by mistake, the mufti tells him that since he did not eat consciously or intentionally, his fast has not broken though the purpose of fasting is to remain hungry. Here, he is considered fasting though his stomach is full because it was not his intention to eat. But in the case of divorce, the mufti says that since he spoke out Talaq three times, the Talaq has occurred though the husband insists that he did not have the intention to divorce his wife.
The Quran clearly says that the husband should have firm intention for divorcing her wife: In Azamut Talaqa (But if their intention is firm for divorce). It means the divorce will not occur if the husband does not have firm intention. And one cannot have firm intention in a fit of anger, under the spell of wine, ganja or bhang or during severe illness. But the method of Talaq approved by our ulema and mufti are in violation of the enjoinment of the Quran. The ulema refused to see reason and did not show any change in approach to Talaq in the prevalent circumstances among the Muslim community.
Since it is the firm belief of the Muslims that all the political and social events on Earth are decreed by God, (Yudabbirul Amr) the passing of Triple Talaq Prevention Bill can also be regarded as God’s intervention as the Muslim civil society failed to take necessary steps to stop the misuse of triple Talaq. It is not the first time God has intervened to save the weaker sections of the society from the social injustice perpetrated to the female species by male chauvinism.
The evil practice of female feticide went on for decades leading to the killing of millions of girl children in mothers’ womb. Statisticians say that about 63 million women are missing and about 2 million babies go missing every year due to female feticide, malnutrition and other forms of discrimination against girls. In 1970, the government had passed bill allowing abortion in certain circumstances. This Act was rampantly misused to kill female foetuses leading to the killing of millions of girl children. When the civil society did not take steps to stop this evil and did not work to bring social reform to change the mindset of people, God had to intervene by paving the way for a law to make female feticide illegal. This stopped female feticide to a great extent thought the evil could not be rooted out completely.
Another instance of God’s intervention was the Prevention of Cruelty to women Act in 1983. Before that the practice of torture and killing of brides was rampant and millions of brides were killed due to this inhuman practice. The civil society could not stop this evil practice too and so finally God had to intervene by paving the way for the passing of the Prevention of Cruelty Act (498).
God loves all its creation. He even loves small insects as much as He loves human beings. So when He sees that men are doing grave injustice to the girls or women and the civil society is not doing anything to root out this injustice on its own, He paves the way for legislations and for that he brings those people in power who are instrumental in bringing such legislation. It is also a form of punishment to those responsible for ignoring the injustice and evil practices.
Now these so-called Muslim intellectuals have started saying that they have no objection to the law but the laws have wrong provisions. They should know that the law passed by the government is not of any Islamic country. So they should not blame the government of an un-Islamic country to bring a fool-proof legislation on Triple Talaq. If they did not want any interference from an un-Islamic government in their Personal Laws, they should have woken up and acted before the government acted.
At least, with the passing of this Bill, the shops of mullahs running Halala business will be closed and women will be saved from going through the indignity of Halala and blackmailing in the name of Triple Talaq.

قال ابن فارس: البغي: الباء والغين والياء، أصلان: أحدهما طلب الشيء، والثاني: جنس من الفساد...والأصل الثاني: قولهم بغى الجرح، إذا ترامى إلى فساد.. ثم يشتق من هذا ما بعده، فالغي الفاجرة....ومنه أن يبغي الإنسان على الآخر...وإذا كان ذا بغي فلا بد أن يقع منه فساد...والبغي: الظلم. (مجموع مقاييس اللغة لإبن فارس ص 144)
وقال زين الدين بن إبراهيم بن محمد، المعروف بابن نجيم المصري الحنفي: البغاة جمع باغ، من بغى على الناس ظلم واعتدى، وبغي سعي بالفساد، ومنه الفرقة الباغية لأنها عدلت عن القصد.. وفئة باغية خارجة عن طاعة الإمام العادل. (البحر الرائق لإبن نجيم، ج 5 ص 150)
قال الحصكفي: البغي لغة: الطلب، ومنه (ذالك ما كنا نبغ) وعرفا: طلب ما لا يحل من جور وظلم (الدر المختار للحصكفي ج4 ص 261)
قال ابن همام الحنفي: والباغی فی عرف الفقهاء : الخارج عن طاعة إمام الحق. والخارجون عن طاعته أربعة أصناف :
أحدها : الخارجون بلا تأويل بمنعة وبلا منعة، يأخذون أموال الناس ويقتلونهم ويخيفون الطريق، وهم قطاع الطريق.
والثاني : قوم کذلک إلا أنهم لا منعة لهم لکن لهم تأويل. فحکمهم حکم قطّاع الطريق. إن قتلوا قتلوا وصلبوا. وإن أخذوا مال المسلمين قطعت أيديهم وأرجلهم علي ما عرف.
والثالث : قوم لهم منعة وحمية خرجوا عليه بتأويل يرون أنه علي باطل کفر أو معصية. يوجب قتاله بتأويلهم. وهؤلاء يسمون بالخوارج يستحلون دماء المسلمين وأموالهم ويسبون نساء هم ويکفرون أصحاب رسول اﷲ صلي الله عليه وآله وسلم . وحکمهم عند جمهور الفقهاء وجمهور أهل الحديث حکم البغاة....
والرابع : قوم مسلمون خرجوا علی إمام ولم يستبيحوا ما استباحه الخوارج، من دماء المسلمين وسبی ذراريهم وهم البغاة. (ابن همام، فتح القدير، 5 : 334)
وقال ابن نجيم: وأما البغاة : فقوم مسلمون خرجوا علی الإمام العدل، ولم يستبيحوا ما استباحه الخوارج من دماء المسلمين وسبی ذراريهم. (ابن نجيم، البحر الرائق فی شرح الکنز الدقائق، 5 : 151)
قال ابن عابدين: هل البغي : کل فئة لهم منعة. يتغلبون ويجتمعون ويقاتلون أهل العدل بتأويل. يقولون : ’’الحق معنا‘‘ ويدعون الولاية. (ابن عابدين، رد المحتار، 4 : 262)
قال الحصكفي: ثم الخارجون عن طاعة الإمام ثلاثة : قطاع طريق... وبغاة... وخوارج وهم قوم لهم منعة خرجوا عليه بتأويل يرون أنه علی باطل کفر أو معصية، توجب قتاله بتأويلهم. ويستحلون دماء نا وأموالنا، ويسبون نساء نا ويکفرون أصحاب نبينا صلی الله عليه وآله وسلم. وحکمهم حکم البغاة بإجماع الفقهاء کما حققه فی الفتح. (حصکفي، الدر المختار، 4 : 262، 263)
ويستدل فقهاء الإسلام بأحاديث لتثبت معارضة الخروج على الإمام ومنها قول الرسول صلى الله عليه وسلم: من أطاعني فقد أطاع الله ومن يعصني فقد عصا الله ومن يطع أميري فقد أطاعني ومن يعص أميري فقد عصاني. (رواه مسلم)
وقال صلى الله عليه وسلم لما سأله رجل: يا نبي الله أرأيت إن قامت علينا أمراء يسألوننا حقهم ويمنعوننا حقنا فما تأمرنا؟ فأعرض عنه ثم سأله فأعرض عنه ثم سأله في الثالثة فجذبه الأشعث بن قيس فقال صلى الله عليه وسلم اسمعوا وأطيعوا فإنما عليهم ما حملوا وعليكم ما حملتم (رواه مسلم)
وقال النبي عليه وسلم: يكون بعدي أئمة لايهتدون بهداي ولايستنون بسنتي وسيقوم فيهم رجال قلوبهم قلوب الشياطين في جثمان إنس قال حذيفة: قلت: كيف أصنع يارسول الله ؟ إن أدركت ذلك ؟؟ قال: تسمع وتطيع وإن ضرب ظهرك وأخذ مالك، فاسمع وأطع. (رواه مسلم)
وقال النبي عليه السلام: من كره من أميره شيئا فليصبر عليه، فإنه ليس من أحد من الناس يخرج من السلطان شبرا فمات عليه، إلا مات ميتة جاهلية. (رواه مسلم من حديث ابن عباس رضي الله عنه ورواه البخاري أيضا)
يجب الحفاظ على الهدف إلى إقامة السلام المتأصل في مثل هذه الأحاديث في عقول المسلمين العائشين في القرن الحادي والعشرين. ولتحقيق هذا الهدف في العصور الحديثة، لا بد لهم أن يفهموا أولا أن الذين يعيشون في ظل حكومة معينة ، غير عادلة أم ديموقراطية حقيقية، يجب أن يتبعوا الحكومة العادلة ويعيشوا بشكل سلمي. وليس من اللازم أن يحملوا الأسلحة ضد الحكومة بطريقة متمردة حتى خلال مواجهة أي نوع من التهميش أو الظلم. وبدلا من ذالك يجب أن يتحلوا بالصبر خوفا من أن بغيهم يؤدي إلى صراع. والسبب هو أن النبي عليه السلام نهى عن البغي حتى ضد الحاكم الظالم،  ناهيك عن الحكومة العادلة. ونلاحظ القاعدة الشرعية المجمع عليها "أنه لا يجوز إزالة الشر بما هو أشر منه، بل يجب درء الشر بما يزيله أو يخففه"، أما درء الشر بشر أكثر فلا يجوز بإجماع المسلمين. وتنطبق هذه القاعدة المجمع عليها أيضا على التنظيمات التي تشن كفاحا متمردا ضد حكوماتهم إذ يؤدي ذالك إلى شر أكبر، فإنها ترتكب جرائم غير إنسانية خارجة عن طاعة الإسلام.
