FATWA FOR PEACE AND HUMAN WELFARE
“ THAT WAS WHY We ordained for the Children of Israel that whoever killed a soul, except for a soul slain, or for corruption in the earth, it should be considered as though he had killed all mankind; and that whoever saved it should be regarded as though he had saved all mankind. Our Messengers brought them proofs; then many of them thereafter commit excesses in the earth.” (Surah Maida, Quran 5:32)

Foreword
Islam is a peaceful, moderate, tolerant and non-communal complete life style. Almighty Allah sent Prophet Hazrat Muhammad (pbuh) to show mercy for all things of this world. There are many examples where Prophet Mohammad (pbuh) and his followers have worked for the welfare of the people.
It is unfortunate that these days some miscreants in order to achieve their contemptible objectives are spreading terrorism and fear in the name of Islam by misinterpreting the Holy Quran and Hadith. They are trying to portray Islam as a brutal and terrorist religion. This is confusing many naïve people. Militants are not only enemies of Islam and Muslims but are enemies of humanity as well. Everyone knows how countries like Iraq, Syria, Afghanistan, Pakistan and African states are being destroyed. Today, our beloved motherland Bangladesh is also facing the same threat.
It is clear that it is impossible for the law enforcement agencies to resist these terrorists alone unless the darkness in their hearts is removed. These terrorists are ready to sacrifice their lives for the sake of religion; thus their conscience must be cleansed in order to bring them to the correct path. Religious leaders can do this by ensuring the correct and pure explanation of Islam. There is no reason to ignore the importance of ‘Fatwa’ (a ruling on a point of Islamic law given by a recognized authority) in Muslim society. Many people still take assistance from ulema (scholars of Islam) and Muftis (those ulema who are certified to issue fatwas or religious rulings) to resolve various religious and social problems by following their ‘Fatwa’. One Hundred Thousand renowned Ulema, Muftis and Imams have decided to collect and publish a ‘Fatwa’ in order to demonstrate the strong stand by Muslims against terrorism and militancy.
Renowned religious leaders had a meeting with Inspector-General of Police (IGP) AKM Shahidul Haque at the Police Headquarters on December 17, 2015 in the present context (of terrorist attacks) in Bangladesh. Forty Ulema and Muftis attended the meeting from various districts of the country. I was the first to raise a proposal in this regard. Everyone agreed to the proposal by understanding its significance. Being encouraged by this, I called a conference with Ulema and Muftis at the premises of Iqra Bangladesh on January 2, 2016 under the initiative of Bangladesh Jamiatul Ulama, a non-political organization representing Ulema and Muftis. Over 300 renowned Ulema, Muftis and Imams attended the conference.
A draft was presented on Istifta and Fatwa during the meeting. The draft was approved with some amendments after a day-long detailed discussion and evaluation. An 11-member committee named ‘one lakh Alim, Mufti & Imam Fatwa & signature collection committee’ was formed with me as the Convener.

The committee has formed coordination committees in every district. These district committees have been instructed to collect Fatwa and Dastkhat (signature). [See the names below]. A form has been prepared to collect signature from Ulema, Muftis and Imams. This form includes information like names, mobile numbers and signature. In today’s digital system the address can be collected from the mobile number. 25 signatures were collected in each sheet for the convenience of counting.
The good news is that there are many women Ulema and Muftis in our country now. Their signatures will also be collected in these forms. We got good response from them in this regard. This is a new addition to the present world.
The committee collected Fatwa and signature of various Islamic institutions in Bangladesh and India including Darul Uloom Deoband, India, Moinul Islam Hathazari, Islamic Research Centre, Basundhara, Char Monai Jamiya Rashidi Islamiya and Shayokh Zakaria Research Centre, Kuril.
The signature collection started on January 3, 2016 and 1 lakh signatures were collected by May 31, 2016. All glory goes to Allah for His grace. Muftis,
Ulema and Aimma Keram have completed this hard task empowered by their love for Allah. They had to go door-to-door to complete this task. We were not able to pay them any money for their service. They have faced criticism in various places. They tolerated this insult with smiles on their faces for their love for Allah, Islam and humanity. This work has been completed in this short period of time only because of Allah’s grace.
The fatwa and signatures have been recorded in 30 sections. Our plan is to send copies of these fatwa & signatures to the UN, OIC, honourable President and honourable Prime Minister. We have already prepared an English and Arabic version of these fatwas.
We got huge support from Muftis, Ulema, Imams, citizen’s forums, law enforcement agencies, intellectuals and the common people. The media activists of local and international media agencies like BBC, Voice of America, Daya Chaples along with all members of the print and electronic media have helped us voluntarily. We have no words to express our gratitude towards them. We pray that almighty Allah may bless them for their service.
All the observers have encouraged us by expressing hope. This explanation by religious individuals will surely play a vital role against terrorism and militancy by upholding Bangladesh’s dignity at the international level. It is unknown whether this type of a major task has been completed in any part of the world.
We have faced some problems while accomplishing this mission. Three types of people have obstructed our work. They represent Jamaat, Shibir and militant groups. They have spread false propaganda against us on Facebook and other social networking sites by accusing us of working against Jihad. There are a group of people who supported our cause, but refrained from giving their signature in fear of militant attacks. There was another group of people who envied our work. We have been able to complete our task by overcoming all obstacles by the grace of Almighty Allah.
It might be asked whether we will be able to resist militancy with a Fatwa. We want to say that one Fatwa is sharper than one lakh weapons. Our mind is the source of our deeds. Fatwa refines the mind by enlightening it and making it more humane. The long-lasting effect of a Fatwa in the Muslim society is undeniable. The ones who are perpetrating terrorist acts in the name of religion are doing it to reach Heaven. They will not take this path if we are able to make them realize that this is not the path to Heaven, but the path to Hell. Thus, there is no doubt that the fatwa would reduce terrorist activities to a great extent. The sponsors of terrorism would be shocked by this. It is a different story for the ones who are committing acts of terrorism for selfish interest like money, women and power. According to Quran, their hearts have become rusty. May Allah take care of everyone.
Miscreants, foreigners and pirates have attacked our motherland in the past, but our people have never surrendered to them. We will once against stand tall as a country of peaceful co-existence by overcoming all these obstacles. There is nothing to fear because Allah is with us.

Some Istifta and questions to Muhtaram Muajaaj Ulama, Mashaikh, Aimma and Mufti Shaheban
A small group is spreading fear and terrorism throughout the globe in the name of Islam. They are killing innocent and helpless Muslim and non-Muslim men, women and children. They are killing people while praying at mosques and other religious establishments. They are killing people in suicidal bomb attacks and declaring this as a martyr’s death. They believe that this brutality is the path to Heaven. As reference they say that it is written in Quran ‘kill kafirs (non-believers) wherever you find them’-Sura Tawba, chapter 9: Verse: 5. It is written in Hadith, that Prophet Muhammad has asserted: ‘I have been instructed not to stop fighting until the people say ‘La Ilaha Illallah’. (Sahih al-Bukhari 6924 & Sahih Muslim 33)
They have claimed these terror activities as Jihad as instructed in Quran and Sunnah. They say that this type of Jihad will continue till Qeyamat (Judgment Day), according to Hadith (Sahih al-Muslim 4718).
In this context we ask the following question to the respected Ulama & Mashayekh Karam, Aimma (Imams) and Mufti Shaheban:
Does Islam, as a great religion of peace, support terrorism and extremist activities? Did our prophets, especially our beloved Prophet Hazrat Muhammad (pubh), preach Islam by applying this type of brutal and ferocious method? Is Jihad and terrorism the same thing in Islam? The answer to each of these questions by Fatwa as per Quran and Hadith
Question No. 1: Does Islam, as a great religion of peace, support terrorism and extremist activities?
Answer: Islam never supports terrorism. In contrast, Islam has emerged to uproot terrorism, jealousy and fighting. Islam is a religion of peace and love.
“He is almighty, holy and peaceful creator”- Sura Hashor: Ayat 23
“All believers enter Islam a path of peace”- Sura Bakara: Ayat 208
“Their lord has a peaceful place for them”- Sura Anam: Ayat 127
“You will be interested in peace and friendship if they want. Keep faith in Allah”- Sura Anfal: Ayat 61
“Allah calls you to a peaceful world”- Sura Yunus: Ayat 25
Islam provides security for both humans and animals
Imam Muslim recited from Hazrat Abu Huraiya:
‘A prophet was bitten by an ant while sitting under a tree. The ant was caught. The prophet instructed his flowers to burn the ant to death. Thus, it was burnt to death. Allah sent a messenger asking ‘you have destroyed an entire community which reads Allah’s Tasbih just because an ant bit you?’ Sahih Muslim, 2: 236
Abdur Rahman ibn-e-Abdullah quoted his father saying:
‘we were with Prophet Muhammad (pbuh) in a journey. Prophet Muhammad went to another place for some reason. At that time, we saw a bird with two baby birds. We took away the baby birds. The mother bird started spanning its wings. Prophet Muhammad returned and asked us who troubled this bird. He told us to return the baby birds to their mother. During that journey we had burnt an ant nest. Prophet Muhammad told us that no one has the right to kill any living creature with fire except Allah who is the creator of fire. -- Abu Dawood, 2/363
Hazrat Abu Huraura quoted Prophet Muhammad (pbuh) saying:
‘A man became thirsty while walking on a road. After quenching his thirst from a nearby well the man saw a thirsty dog. He said to himself that this dog is suffering from thirst just like him. He went back to the well and brought water in his socks and quenched the dog’s thirst. Almighty Allah, being pleased with his good deed, forgave his sins.
Sahabay e Karam (companions of the Prophet (pbuh)) asked Prophet Muhammad (pbuh) ‘will we gain blessings by serving animals? Muhammad said ‘serving every living being has blessings.’ Muslim 2: 237
Hazrat Abu Huraira quoted Prophet Muhammad (pbuh) saying ‘a woman saw a thirsty dog roaming around a well. She quenched the dog’s thirst by bringing water in her socks. All her sins were forgiven. Muslim, 2: 237
Islam does not support even shredding leaves from a tree without any reason
Isahak Ebne Rahawaia quoted Abu Bakar saying ‘killing animals and shredding leaves from a tree reduces Allah’s Tasbih. Durre Mansur: 5: 2114
According to a hadith, Prophet Hazrat Muhammad (pbuh) considered love to be the greatest virtue.
“Our love for Allah pleases Him more than anything”- Abu Dawood, 4588
The holy Quran has clearly cited Prophet Muhammad as a blessing and mercy for the entire world.
“I have sent you as a blessing.” Sura Ambia: Ayat 107
The Muslim ‘Ummah’ (community) has been cited to be for the welfare of humanity
“You are the greatest nation. You have been sent for the welfare of humanity. Do good deeds and stop misdeeds.” Sura Al Imran: Ayat 110
Cited from Hurayra R. (Someone said the Prophet p.b.u.h): “Rasululllah, curse the non-believers”. Hazrat Muhammad (sm) said, “not to spell the curse, I have been sent as a symbol of mercy and kindness. (Muslim, Hadith no-6556)
Despite having been the victim of brutality of Taif, he always prayed for the betterment and welfare of them. (ibn Hisham, Al-Kamil, Al –Bidaya, wan-Nihaya)
In Holy Quran it is clearly stated not to create any kind of turmoil and terrorism in the earth
Don’t create turmoil after establishing peace in earth. Pray for Allah with fear and hope. Undoubted, the mercy of Almighty Allah is at the nearest of you all. Surah A’Raf, Chapter 7: Ayat: 56)
It is declared that creating terror and panic is the work of the Non-believers
There is a kind of person among people whose speeches regarding worldly universe will amuse you and whatever he has in his mind for that he will quote Almighty Allah, actually he is contentious. When he leaves, he tries to create corruption and destroy paddy fields and animals. And Almighty Allah does not like corruption, agitation and terror (Surah Baqara, Chapter 2; Verse: 204)
According to the Holy Quran, to protect the life of a person is like saving the entire mankind and on the contrary, to kill one unfairly is to kill the whole mankind.
That was why We ordained for the Children of Israel that whoever killed a soul, except for a soul slain, or for sedition in the earth, it should be considered as though he had killed all mankind; and that whoever saved it should be regarded as though he had saved all mankind. Our Messengers brought them proofs; then many of them thereafter commit excesses in the earth. (Sura Maida, Quran 5:32)
One hadith describes the identity of Muslim as follows
Hadith: “A Muslim is one from whose tongue and hand Muslims are safe.” -– Sahih Bukhari, Book of Iman, Musnade Ahamed 11 no B, p-658, Haddith No 7086

Question No. 2: Did our prophets especially, our beloved Prophet Hazrat Muhammad (pubh), preach Islam by applying this type of brutal and ferocious method?
Answer: Hazrat Muhammad (pubh) never ever followed the way of brutality and ferociousness for establishing Islam. The way of establishing Islam is the way of love and calling for Islam. It’s the way of calling for Islam with love and affection. Hazrat Muhammad and his followers have always called the people in Islam for the welfare through the way of love and service. The life of Prophet (pubh) is the burning example of this.
Outreach with clarity is our responsibility (Surah Yasin, Quran: 36: 17)
You are not over them a controller. (Ghashiya: Quran: 88: 22)
Let there be no compulsion in religion (verse: Baqara, Quran 2: 256)
For you your religion, for me mine. (Sura Kafirun, Quran: 109: 6)
One day Hazrat Muhammad (pubh) was asked, is it possible to establish welfare following the way of evil deeds? He clearly stated, No, never ever possible to do so.
Abu R cited, one day, a man asked Hazrat Muhammad (pubh) whether it is possible to get something better doing evil deeds. Then, Prophet answered only good ways can bring some good things which means to establish something good, its path also has to be good. ……….
So, conflating terror with Islam and Muslim community is considered as the extreme lie and the task of non-believers. ………
Terrorists are never considered the friend of Islam and Muslim community. They are clearly the enemies. To warn regarding them is the responsibility of us all. …..

Question no 3: Are Jihad and terror the same in the eyes of Islam?
Answer: Jihad and Terror are not the same in the eyes of Islam. Jihad is an instruction of Islam; on the contrary, terror is forbidden and illegal. Jihad is the continuous attempt for establishing peace, security and everlasting welfare for own self, environment and society.
From Nafi’ bin Azraq, it is described about Hazrat Ibn Umar (R), in the time of Ibn Zubir, two people came to Hazrat Ibn Umar and said people are being devastated and in spite of being the son of Umar and the disciple of Hazart Muhammad, why don’t you go for Jihad? Ibn Umar answered, Almighty Allah has declared it forbidden. The two men again said that Allah has asked to fight until the persecution ends. Then Ibn Umar replied we are fighting for diminishing persecution and convey the trustworthiness to Almighty Allah but you want fighting for creating persecution, creating trustworthiness to the non-believers.
According to Ibn Usman Salehah, one man came to him and asked, Abu Abdur Rahman, you go for Hajj every year and for Umra but abandon Jihad, don’t you know how much emphasis Allah put on Jihad?
Ibn Uma replied, listen! My nephew, the pillars of Islam are five – Faith in Allah and prophethood of Mohammad (pbuh), prayers for five times, Roza (fasting) in the month of Ramazan, Zakat (Charity) and Hajj.
Then the man said, the father of Abdur Rahman, didn’t you hear how Almighty Allah expressed? If there is a collision between two parties, then mitigate that.
When people became Muslim at the time of Hazrat Muhammad (pbuh) as the Muslims were minor then, the non-believers killed them or punished them, we fought at that time as well. As a result, the number of Muslims is on increase and the persecution is on decrease.
It was narrated from Imran bin Husain, he said:
“Nafi’ bin Azraq and his companions came and said: ‘You are doomed, O ‘Imran!’ He (Imran) said: ‘Who doomed me’?
They said: ‘Allah says: “And fight with them until there is no more Fitnah (disbelief and polytheism, i.e., worshipping others besides Allah), and the worship will be all for Allah Alone.”
He said: ‘we fought them until they were defeated and the worship was all for Allah Alone. If you wish, I will tell you a Hadith that I heard from Rasoolullah Sallallahu Alaihi Wasallam (the Messenger of Allah).’ They said: ‘Did you really hear it from the Messenger of Allah?’
He said: ‘Yes. I was with the Messenger of Allah and he had sent a platoon of Muslims to fight against the idolaters. When they met them they fought them fiercely, and finally the idolaters surrendered before them. Then a man among my kin attacked one of the idolaters with a spear, and when he was defeated he recited the Kalima and said: “I bear witness that none has the right to be worshipped but Allah, I am a Muslim.” Despite this he stabbed him and killed him. After this, he came to Rasoolullah Sallallahu Alaihi Wasallam (the Messenger of Allah) and said: “O Rasoolullah, I am doomed.”
Rasool Sallallahu Alaihi Wasallam once or several times said
“What is it that you have done?” He told him what he had done and Rasoolullah Sallallahu Alaihi Wasallam said to him: “Why did not you cut open his chest and find out what was in his heart?”
He said: “O Rasulullah, I wish I had cut open his chest and could have known what was in his heart.” Rasoolullah Sallallahu Alaihi Wasallam said:
“You did not accept what he said verbally whereas you do not know what was in his heart!” Rasoolullah Sallallahu Alaihi Wasallam remained silent concerning the man.
A few days later the man died. We buried him, but in the following morning his body was seen lying on the surface of the earth. People whispered: “Perhaps an enemy of his disinterred him.”
So we buried him again and asked our youths to guard the grave. But in the next morning the body was on the surface of the earth again then we said: ‘Perhaps the youths dozed off.’ So we further buried him and stood guard ourselves, but the following morning his body was on the surface of the earth again. So, we threw him into one of the valleys.’”
In another document the same Hadith was narrated from Imran bin Hussain with an addition that after being known about the man (whose body was seen on the surface of the earth repeatedly) Rasoolullah Sallallahu Alaihi Wasallam had said:
“the soil receives person more repugnant than the man but the Almighty Allah wants you to realize the divine grace of La Ilaha Illalah” (There is no worthy of worship but Allah Alone). Ibne Majah, Hadith No. 3930
Excelling oneself as an honest person abandoning all the evil inherent vices has been described as the best Jihad in Hadith. In Bayhaqi Kitabuz Zuhd, it was narrated from Hazrat Zuber (R): After end of the war, a team of people came to the Rasoolullah Sallallahu Alaihi Wasallam. Rasoolullah Sallallahu Alaihi Wasallam said:
‘Welcome you to the greater Jihad from the smaller Jihad and wish every success in your journey.’ They said, “which one is the greater Jihad?’ Rasoolullah Sallallahu Alaihi Wasallam said ‘The battle against self, ego’.
Nasai Rahmatullah narrated in Kitabul Kuna: They said “which one is the greater Jihad?’
He said, “the Jihad of mind/heart.” --- Bayhaqi and Nasai
No effort can be considered as Jihad if pure niyat (intention for prayer) is not made for obtaining satisfaction, blessings and welfare from Allah.
It has been narrated from Abu Musa Ash'ari (R.) that a Bedouin (a man from Arab semi-nomadic group) Arabian asked the Messenger of Allah about fighting in the way of Allah, the Exalted and Majestic, a man who fights out of rage or out of family pride. Rasool Sallallahu Alaihi Wasallam said:
Who fights that the word of Allah be exalted fights in the way of Allah. Muslim, 1904
If any organ of the body begins to decompose, it becomes essential to undergo operation for keeping the body safe and sound. Similarly, the armed battle or qital is allowed to protect and save the whole creature from the fear of terror and violence. (See Jihad parts of Hadith books)
It is said in the Holy Quran:
“For, had it not been that Allah checks one set of people by means of another, monasteries, churches, synagogues, and mosques, wherein the name of Allah is mentioned much, would surely have been pulled down. Allah surely helps those who help His (Cause). Truly, Allah is All-Strong, All-Mighty. Sura Hajj, Quran 22: 40
However, many terms and conditions were attached while the qital or armed battle was approved. Any type of transgression or misdemeanour has strongly been prohibited. It is described in the Holy Quran:
“Transgress not. Verily, Allah does not like the transgressors.” Al-Maeda, Quran 5: 87
“And if you are punished by your enemy, then punish them with which you were afflicted. But if you endure patiently, verily, it is better for the patient ones.” Sura an-Nahal, Quran 16: 126

Question no. 4: Is Terrorism the way for obtaining the Heaven or going to the Hell?
Answer: As the bid to initiate terrorism and fear is strongly prohibited, such steps cannot be a way of gaining the Paradise. It is nothing but a way to the Hell. Those, who have now got involved with terrorism and militancy for gaining the Heaven, should leave the way of Hell like terrorism and return to the way of peace and tranquillity if they really want to gain the Paradise.
“Do good as Allah has been good to you, and do not try to create mayhem in the land. Verily, Allah dislikes those who commit great crimes and sins, oppressors, tyrants, mischief-makers, corrupters.” Sura Qasas, Quran 28: 77
“Shall we treat those who believe in the Oneness of Allah and do righteous, good deeds, as those who associate partners in worship with Allah and commit crimes on earth?” Surah Saad, Quran 38: 28
“Allah will surely make it of no effect. Verily, Allah does not set right the work of the evil-doers, corrupters.” Surah Yunus, Quran 10: 81

Question no 5: Would the death of suicidal terrorist be considered as martyrdom?
Answer: Committing suicide and suicidal attacks are Haram (forbidden) in view of Islam.
“Do not kill yourselves (nor kill one another). Surely, Allah is Most Merciful to you.” Surah Nisa, Quran 4: 29
Blowing out oneself as human-bomb is not legal. When a man, who participated in Jihad, committed suicide after being wounded during the war, Rasoolullah Sallallahu Alaihi Wasallam declared him a person of Hell.
It has been narrated by Sahl bin Saad Al-Saidi:
Rasoolullah Sallallahu Alaihi Wasallam and Mushriks (polytheists) once met each other in a battle and started fighting. There was a man amongst the companions of Rasoolullah Sallallahu Alaihi Wasallam who would follow and kill with his sword any Mushrik going alone. Someone said, "Nobody did fighting so properly today as that man." Rasoolullah Sallallahu Alaihi Wasallam said, "Indeed, he is amongst the people of the Hell."
A man amongst the people said, "I shall accompany him to watch what he does". The narrator described:
“Thus he accompanied him, and wherever he stood, he would stand with him, and wherever he ran, he would run with him. Then the brave man got wounded seriously and he hurried to die quickly. So he planted the blade of the sword in the ground directing its sharp end towards his chest. Then he leaned on the sword and killed himself. The other man came to Rasoolullah Sallallahu Alaihi Wasallam and said, "I testify that you are the Messenger of Allah.” The Prophet asked, "What has happened?"
“He replied, "It is about the man whom you had described as one of the people of the Hell. The people were greatly surprised at what you said, and I said, 'I will find out his reality for you.' So, I came out seeking him. He got severely wounded and hastened to die by slanting the blade of his sword in the ground directing its sharp end towards his chest. Then he eased on his sword and killed himself."
“Then Rasoolullah Sallallahu Alaihi Wasallam said, "A man may seem to the people as if he were practicing the deeds of the people of Paradise while in fact he is from the people of the Hell, another may seem to the people as if he were practicing the deeds of the people of Hell, while in fact he is from the people of Paradise." -- Bukhari, 2/504
Suicide is such a major sin in Islam that offering Janaza (funeral prayer) for the person who commits suicide is strictly forbidden. “No Janaza can be offered also to the treacherous, robbers, violators of the state-rules, killer of parents and anyone who kills himself.” -- Fatwa Sami, 3/103
Similarly,
“the funeral prayer could not be offered to whoever commits suicide by hanging himself,” narrated from Abu Hanifa. Abu Yusuf said: “Whoever kills himself would never be included in the list of martyrs. His death will never be considered as the death of a martyr.”
It was narrated from Abu Huraira,
“whoever throws himself down from a mountain and kill himself will be in the fire of Hell, throwing himself down therein forever and ever.” Muslim, 139
Sabet Ibn Jahhak described:
“Whoever kills himself with sharp weapon, the weapon will be in his hand and he will be stabbing himself with it in the fire of Hell forever and ever.” Muslim 110

Question 6: Is Genocide legal in Islam?
Answer: Mass-killing of innocent people is not legal in Islam. It is forbidden to kill anyone even based on suspicion. It was narrated from Ayesha Razi Allah Tala Anhu, Rasoolullah Sallallahu Alaihi Wasallam said:
“Stay away from applying Hudud (punishments which under Islamic law are mandated and fixed by Allah) on Muslims as much as possible. If there is even a little option, then forgive them. Committing mistakes by showing forgiveness is better than committing mistakes by applying power.” Tirmizi, 1/26
“Hudud (punishment) cannot be applied if there is any confusion.” Sami, 6/25
It was narrated from Ibrahim, Umar (R) said
“it is better to stop applying Hudud on the basis of suspicion, I believe so.” Hashiare Hedya, 1/493

Question 7: Does Islam support indiscriminate killing of children, women and elderly people?
Answer: Killing of the children, women, old and weak people, who are not engaged in war, is strongly prohibited in Islam. Even such murders are now allowed during the period of war. When the group of Muslims used to get out for qital or armed battle, then Rasoolullah Sallallahu Alaihi Wasallam warned them strongly about the matter.
Narrated Anas ibn Malik:
“Rasoolullah Sallallahu Alaihi Wasallam used to say while sending any troop for war: Go in Allah's name, trusting in Allah. Do not kill a decrepit old man, or a young infant, or a child, or a woman; do not be dishonest about booty, but collect your spoils, do right and act well, for Allah loves those who do well.” Abu Daud, 2614
It is also described in Bayhaqi,
“Do not kill the ill ones, or saints, or cut the fruit-trees or evacuate the human habitations. Do not slay the camel or cattle if there is no need of food.” Abu Daud 2614

Question no. 8: What kind of crime is Killing people during prayers?
Answer: Killing people in any situation is a sin. And killing anyone during prayer is a severe crime.
“Whoever kills a believer intentionally, his recompense is Hell to abide therein.” Sura Nisa Quran 4: 93
“And do not kill anyone, which Allah has forbidden, except for a just cause.” Sura Isra, Quran 17: 33
It is not for a believer to kill a believer except (that it be) by mistake, but killing a believer by mistake, is a different issue. Sura Nisa, Quran 4: 92

Question 9: Is attacking churches, temples, pagodas etc. legal in Islam?
Answer: Anyone who kills a non-Muslim living in a Muslim society will never be able to go to Heaven. Attacking churches, temples, pagodas used by non-Muslims is illegal in Islam. This is a punishable crime.
The Christian churches, Jewish temples and monasteries would have been destroyed if Allah had not prevented a group of people by another group of people. May Allah’s name be remembered at all the mosques. Allah will surely help the ones who help Him. He is almighty. Sura Hajj: Quran 22: 40
It is mentioned in Tafsir-e-Ibne Abbas that it is forbidden to destroy churches of Christians and temples of Jews, because they are under the protection of Muslims.
Qurtubi explains this verse by saying
‘this verse proves that it is forbidden to destroy churches and temples used by non-Muslims.’ Qurtubi, 6/345
Mawardi in his Tafsir (exegesis) said
‘Non-Muslims would have been destroyed if Allah had not protected them through Muslims.’
Sarhush Siyar says:
‘Muslims will not be able to stop non-Muslims from building their religious establishments even after taking them (non-Muslims) as hostages after winning the war.’ Roddul Muhtar 6: 328
According to the hostage agreement, Muslims will not be able to torture them (non-Muslims) or hurt them. Prophet Hazrat Muhammad (pbuh) said
‘beware I will bear witness against any Muslim who will torture a non-Muslim till Qeyamat (Judgment Day).’ Abu Dawood, Hadith no. 305
Every non-Muslim hostage and non-Muslim must be given the freedom to practice their own religion. They will be able to practice their religious rituals (like- tolling the bell etc.). Muslims will not be able to hinder them in this regard. They will be able to do what is legal in their religion like - drinking alcohol, selling pork and feasting during Ramadan. Question 10: Is it or is it not our duty to form social resistance against terrorists and extremists in the eyes of Islam?
Answer: It is everyone’s duty to form a social and personal resistance to prevent Munkarat or misdeeds. At present terrorists are portraying Islam and Muslims in a distorted way to the world. This is nothing but an evil conspiracy against Islam and Muslims. Thus, it is everyone’s religious duty to form social and personal resistance against this force. There is no scope to remain silent.
Qais Ibn-e-Abi quoted Abu Bakar saying ‘I have heard Prophet Hazrat Muhammad (pbuh) say that Allah would double the punishment for anyone who does not resist sinful acts. Jassas, Ahkamul Quran, Surra Mayida, Ayat 105
Jarir Ibne Abdullah quoted Prophet Hazrat Muhammad (pbuh) saying ‘Allah will multiply punishment if they do not resist sinful nations.’
It is mentioned in a hadith ‘resist any misdeed with bare hands, your hands if you have the ability (at present the law enforcement agencies are appointed to do this). If you don’t have the ability then resist with your words (at present Alim Ulama, Pir Mashayekh, Mufti Saeban, Imam, Khateeb Wayezin, journalists, educationists, and elites are appointed to do this). Abu Sayeed quoted Prophet Hazrat Muhammad (pbuh) saying ‘resist any misdeed with bare hands, your hands, if you have the ability. If you don’t have the ability, then resist with your words. If you are unable to do any of these then express hate from your heart. This is the weakest side of faith.
It is the duty of the Ulama-e-Karam to prevent through words and that of the judges and concerned individuals to prevent using their power and hands.
It is mentioned in Zahiriha Kitab that it is the duty of the judges and government to prevent by hand. Ulama (plural of alim, scholar) will prevent through words and the common people through hate in their hearts.
Postscript:
The references which the terrorists are giving from Quran’s Ayats and AHadith (plural of Hadith) to support their misdeeds are nothing but a distorted misinterpretation of Quran and Hadith. Partial presentation of the Ayat is sending a wrong interpretation. The meaning of these ayats and hadith is not comprehendible to common people. This ayat is applicable for the enemies who have engaged in war unjustly by denying extending the term of truce.
Ibn-e-Arabi in his Ahkamul Quran wrote ‘the objective of this ayat is to fight against the Mushrik who are fighting against Allah. “If any Mushrik seeks refuge give him shelter so that he is able to listen to Allah’s words. Escort him to a safe place, because he is of a nation which is ignorant.”
Qurtubi in his Tafsir explained this ayat by saying ‘It is mentioned in Syeed Ibne Zubair that a Mushrik came to Hazrat Ali and him whether any Mushrik would be able to come to Prophet Hazrat Muhammad (pbuh) after 4 months? Or will he be killed? Ali said that he will not be killed, because Allah has ordered to give shelter to any Mushrik who seeks refuge so that he might listen to Allah words.
Almighty Allah, please show us the true path and help us follow this path. Show us what is wrong and untrue and help us to remain away from them. Amin.
