Opinions of Leading Scholars of Different Schools Of Thought Translated by New Age Islam Edit Desk Main Points: 1. In Islam, a slogan like "Sar Tan se Juda" is wholly inappropriate. 2. The fundamental point is that blasphemy law is not applicable in a democratic country like India. 3. Blasphemy against the Prophet (peace be upon him) carries the death penalty in Islamic countries; but, the judge and the government have the authority to impose this penalty, not the average citizen. 4. No insulter could even remotely reduce the great Prophet's glory, whose name has been exalted by Allah Almighty. ----- By Maulana Abu Talib Rahmani (Member of the General Body of All India Muslim Personal Labor Board) Nothing is more vital or significant to a Muslim than the honour, dignity, and respect accorded to the Prophet of Allah (peace and blessings of Allah be upon him). Even a humble Muslim loses control of his emotions when a severely depraved individual disparages the honour of the beloved Prophet. This is a normal occurrence. This is what love demands. But Islam is a wonderful faith. We are always guided by Islamic law or sharia. In every circumstance, we must maintain emotional control. The holy Shariat and Islam are the sources of these sentiments and directives. However, we should not let our anger turn negative. We have to use this anger positively. It is clear that men cannot always act positively and refrain from taking bad action when they are angry or feeling emotional. Here, in order to better handle the situation, our eminent scholars, Ulama, and religious leaders are required. Our scholars and leaders must assume responsibility on their own. No one will demand that we follow them. There are just the scholars present who are better able to control the situation when people are furious and upset. Each country has laws. A Muslim is not allowed to meddle with the legal system of the country he lives in. Blasphemy has caused conflict in society and posed a threat to the country's peace and order. Muslims' ability to express their feelings and emotions can aid the devil if they do so. Never yell anything that is against the law or morality, especially if you're a Muslim. A society cannot be held responsible for the deeds or remarks of a single person. In the first century, Hazrat Abu Bakr Siddiq's caliphate had a centralised government and legal system in place when the call for the defence of the Prophet's honour was made. None of the Muslims ever raised their arms or stood up. Even if there is any historical precedent for it, it violates Islamic law. A democratic nation is India. A system and constitution still exist. The struggle and the endeavour must be conducted within the bounds of the law. If they violate the letter or spirit of the law, it is damaging and goes against Islamic beliefs and ideals. ۔۔۔۔۔۔۔۔۔۔ Maulana Muhammad Rahmani (Sadar Maulana Abul Kalam Azad Awakening Centre) In Islam, a slogan like "Sar Tan se Juda" is wholly inappropriate. Even though the average person lives under an Islamic government, such slogans are categorically forbidden for him. Instead, the Islamic government must decide how to punish those who raise such slogans in order to ensure the restoration of peace and security. How can such a crime be tolerated in non-Islamic nations when it is prohibited in Islamic nations? It should be obvious that in an Islamic nation, blasphemy against the Prophet (peace be upon him) carries the death penalty; but, the judge and the government have the authority to impose this penalty, not the average citizen. Muslims have a duty to uphold the Sunnah and the biography of the Prophet under such circumstances, as well as to put their teachings into practice. Regarding those who make fun of or insult the Holy Prophet (peace and blessings of Allah be upon him), Allah, the Lord of the Universe, says: “Indeed, We are sufficient for you against the mockers” (15:95). The Lord of the Universe commands His Messenger (peace and blessings of Allah be upon him) to ignore the mockers and to continue preaching the religion (for details, see Surah Hajar, verses 94-99). In this case, the Muslims have a political duty to forge unity, formulate a solid strategy for the future, act legally and vehemently, and pursue their claims within the bounds of the law of their country. Keep in mind that Muslims themselves are guilty of criminal negligence when it comes to the Sunnah of the Prophet (peace and blessings of Allah be upon him) and frequently err by placing their own jurisprudential concerns before hadiths. This also qualifies as a form of blasphemy. In such a situation, we should consider the verse, which reads, “And whatever strikes you of disaster - it is for what your hands have earned, but He pardons much.” (24:30). The leaders of various schools of thought should develop unified action plans, and ordinary Muslims should act accordingly. They should also have a conversation with the relevant government representatives. ۔۔۔۔۔۔۔۔۔۔۔ Maulana Abdul Ali Farooqui The rector (Muhtamim) of Madrasah Farooqia Kakuri Insofar as this slogan “Sar Tan se Juda” is concerned, it should not be raised. The fundamental point is that blasphemy legislation, which was influenced by Islamic Sharia law, can be applied in Islamic countries. In a nation like India, it is unimaginable. Provocative speech of this nature is harmful. Shariah does not sanction such behaviour in nations like India. Protesting should be done, but it should be done with the right mindset. The current approach is by no means appropriate. Provocative slogans shouted in the streets during the rally will make things worse. Muslims must properly tell the authorities and express their outrage by sending a delegation and publishing their letter in the press. Insulting anyone is against the law in our nation. No religious leader may be insulted, as stated explicitly in the constitution. Given the significance of Prophet Muhammad (PBUH) to Muslims, we might assert that the authorities should pay attention to us and, if they refuse, then we should file a lawsuit. In this regard, a suitable method should be adopted by mutual consultation, but one should not remain silent. When the academics (Ulama) from all sects and schools of thought have gathered, a strategy must be developed. But our inability to assemble is the primary problem. ------ Mufti Omar Abidin Qasmi Madani (Deputy Nazim of Al-Mabad- al-Aali al-Islami, Hyderabad) It is a major offence to blaspheme against the glory of Allah's Messenger. Such initiatives are being done in India, but they simply serve to exacerbate sectarianism and contaminate the environment. In order to prevent communism from destroying this nation, those who truly love the government and the people must take strict legal action against these criminals. According to Islam, there should only be one God to be worshipped. It teaches that no religious leader should be mocked despite differences in viewpoint and that other holy places should also not be disregarded. Praise be to Allah (Alhamdulillah), Muslims as a whole have been following these instructions. In accordance with Islamic law, an Islamic state is required to impose the most severe penalties for offences, and this is only possible through legal processes. Therefore, it is improper to use such slogans that express breaking the law or the enforcement of punishment in a democratic nation. In such circumstances and accidents, Muslims should adopt the following actions. Litigation: In order to take special note of instances of blasphemy and take legal action while considering all alternatives, a national group of jurists and other bodies should be established. Additionally, legislation should be passed by state legislatures. The local circumstances and sensibilities should be taken into consideration when conducting organised protests. Public outrage and protest have merit, but it's important to consider local sensibilities. At various levels, a joint delegation should meet with the government and key authorities to present their demands. Dialogue between religions ought to take place. The human values drawn from the life of the Prophet should be conveyed during the month of Rabi ul-Awwal and on other occasions, and social media channels should be heavily utilised for this. Social norms should be shaped in the Prophet's style (peace and blessings of Allah be upon him). All of these actions should be taken due to the frequent occurrence of such traumatic events. ۔۔۔۔۔۔۔۔۔ Saeed Raza Noori Founding President of Raza Academy, Mumbai Blasphemy is considered to be the worst kind of crime by Muslims. Strict protests and demonstrations should be held in opposition to anyone who commits blasphemy. But in addition to that, the environment needs to be examined. Protests ought to be permitted by the law. The only role of the government is to impose punishment, whether it be domestically or abroad. The role of the public is to protest and file lawsuits. They should avoid using catchphrases like "Sar Tan se Juda," which are impossible to employ or impose on other people. We should organise a powerful campaign to pass anti-blasphemy legislation that would sentence blasphemers to at least ten years in prison. Scholars and Muslims from all sects should work together to promote the passage of legislation that would punish those who disrespect the Prophet (peace be upon him), just as they did in 1974 when all Muslims started a campaign to proclaim the Qadianis non-Muslims. …. Blasphemy against The Prophet (Peace Be Upon Him) Is Not Possible Mufti Athar Shamsi Director, Al Quran Academy Kairana, Shamli To me, blasphemy against the Prophet is inconceivable. The splendour of the Prophet of Allah (peace be upon him) is so great that there is no chance for any insulter to lower the majesty of this glorious figure. Everywhere you look, you can see how great of a personality this Prophet (peace be upon him) has. The Qur'an itself states of him, "And We have exalted your remembrance for you (O dear Prophet)". (94:4) Well, Is there anyone who could even remotely reduce the great Prophet's fame, whose name has been exalted by Allah Almighty? The claim that the Islamic Prophet has been insulted (Nauzubillah/We seek refuge in Allah) is evidence of a lack of knowledge or a lack of a profound understanding of the Prophet's majesty. Yes, some idiots still use derogatory language against the Prophet Muhammad (peace and blessings of Allah be upon him) to express their own humiliation. We are aware of the method used to command the Prophet (peace and blessings of Allah be upon him) to respond to the criminal miscreants of those who attempted to defame Muhammad, the Messenger of Allah (peace and blessings of Allah be upon him). Surah Al-Hijr, verses 94–95, of the Quran, provides the source for this information. These verses read, “Then declare what you are commanded and turn away from the polytheists. Indeed, We are sufficient for you against the mockers” (15:94-95) In these verses of the Quran, it is explicitly stated that we are to take a posture of distancing ourselves from those who strive in vain to defame the dignity of the Prophet of Allah (peace and blessings be upon him). The Quran says, “Be patient over what they say and avoid them with gracious avoidance.” [Surah al-Muzzamil, 73:10] and “So be patient over what they say and exalt with the praises of your Lord before the rising of the sun and before its setting.” [Surah Qaaf, 50:39] The only response to such wrongdoing, in view of these Qur'anic verses, is a patient plan that includes legal action. Slogans like "Sar Tan se Juda" are in opposition to the Quran and the Prophet's Sunnah (peace be upon him). There are some ways to address the unsuccessful blasphemy attempts: (1) One of them involves bringing the insulter to justice in an effort to stop any significant social unrest and chaos. (2) The door of discourse must be opened with any person who dares to do so and with all of the nation's residents through "open dialogue," employing all available media in a polite and cutting-edge rational manner. If this is done, the truth will be plainly visible to these people's eyes. (3) Muslims themselves should deeply study the biography of the Prophet (peace be upon him). Al-Quran Academy Kairana is working on these lines of thinking with its limited resources. … Urdu Article: Nothing is more valuable Than the Honour of the Prophet Muhammad PBUH, but Slogans like "Sar Tan Se Juda" Are Utterly Incompatible with Islam آقائے نامدار کی ناموس سے بڑھ کر کچھ نہیں ’سر تن سے جدا‘ جیسا نعرہ سراسر غیر اسلامی ہے URL: https://newageislam.com/radical-islamism-jihad/sar-tan-se-juda-honour-prophet-muslims/d/127850 New Age Islam, Islam Online, Islamic Website, African Muslim News, Arab World News, South Asia News, Indian Muslim News, World Muslim News, Women in Islam, Islamic Feminism, Arab Women, Women In Arab, Islamophobia in America, Muslim Women in West, Islam Women and Feminism
