Speaking of fatwas: What about female circumcision?

Last month, a group of prominent Muslim scholars met in the Turkish city of Mardin to revisit the Mardin fatwa, the 14th-century legal edict written by Muslim scholar Ibn Taymiyya, who lived during the brutal Mongol invasion. While the Mongols eventually embraced Islam, they unleashed terror on their religious brethren. Ibn Taymiyya declared that, although the Mongols were nominally Muslim, they did not rule according to classical Islamic law and, therefore, could be killed. The Mardin fatwa is often quoted by Osama bin Laden and other extremists to excommunicate and murder Muslims who don’t share their views. The fatwa is also used to justify the murder of unarmed combatants.

The scholars declared that these interpretations of the Mardin fatwa are erroneous, that the killing of non-combatants is forbidden. Furthermore, they made it clear that jihad has multiple meanings, one of which is armed conflict. But only a head of state, not individuals, can declare armed jihad, and only as a defensive means against aggression.

The strong opinion followed a remarkable 600-page fatwa issued by an influential Pakistani scholar, Muhammad Tahir-ul-Qadri, who categorized individuals committing terrorism in the name of Islam to be outside the fold of the faith. He, too, said in no uncertain terms that the killing of non-combatants is forbidden, as is suicide. Suicide bombings, he said, lie outside the bounds of Islam and can in no way be justified. He reiterated this stand by condemning the “black widow” terror attacks in the recent Moscow subway bombings.

Osama bin Laden's son has a chilling warning for those who are hunting his father with drones, secret agents and missile strikes.

From Omar bin Laden's up-close look at the next generation of mujahideen and al Qaeda training camps he says the worst may lie ahead, that if his father is killed America may face a broader and more violent enemy, with nothing to keep them in check.

"From what I knew of my father and the people around him I believe he is the most kind among them, because some are much, much worse," Omar bin Laden, who was raised in the midst of his father's fighters, told ABC News in an exclusive interview. "Their mentality wants to make more violence, to create more problems."

Omar has turned his back on his father's philosophy, a remarkable step for a man in an Arab culture where it is a sin to disobey his father and taboo to openly criticize him. It was doubly significant for Omar bin Laden because his father had picked him to succeed him as the leader of jihad.

The son spoke out again recently after hearing his father in an audio tape praise the attempt by the so-called "underwear bomber" to blow up a jetliner over Detroit on Christmas Day.

"Attacking peaceful people is not being fair, it is unacceptable. If you have a problem with armies or governments you should fight those people. This is what I find unacceptable in my father's way," Omar told ABC News.

There is also a strong Indonesian tradition of resolving disagreements through “musyawarah dan mufakat” (consultation and consensus). Of course, this tradition has not always prevented violence, most notoriously in the killings that followed the 1966 coup against President Sukarno. And ten years ago, during the financial crisis, violent anti-Chinese riots erupted again, causing many Chinese to flee the country.

Today, however, many of those Chinese have returned. In a remarkable development, Chinese language and culture, which had been suppressed for decades, is allowed free expression. By contrast, imagine Turkey, a more advanced member state of the Organisation of the Islamic Conference, allowing free expression of Kurdish language and culture.

Indonesia’s record looks even more remarkable when compared to the United States. Americans explain their country’s democratic backsliding by pointing to the 9/11 terrorist attacks. But Indonesia was attacked, too, with the bombing in Bali coming little more than a year later, on October 12, 2002. Despite this, Indonesia has consolidated its democracy. Indeed, in 2005 Freedom House declared that Indonesia had moved from “partly free” to “free”.
