Zardari Is Running Out Of Options

The message is loud and clear: activate the Swiss money laundering case in Geneva against Mr Zardari, get him convicted and bring back the plundered money. A conviction in Geneva would be sufficient grounds to knock Mr Zardari out of the Presidency.

Third, most critically, the court has relied on the “ Islamic injunctions” in the constitution, even though these are based on vague notions of “ morality”. In particular, reference has been made to Articles 62 and 63 of the constitution inserted therein by that great Islamist fraudster- gangster, General Zia ul Haq.

These relate to conditions of qualification and disqualification from being a member of parliament ( like the president of Pakistan). Article 62 ( d): he is of good character and is not commonly known as one who violates Islamic Injunctions.

Article 62 ( f): he is sagacious, righteous and non- profligate and honest and ameen. Article 63 ( a): he is of unsound mind and has been so declared by a competent court. Article 63 ( g): he is propagating any opinion, or acting in any manner, prejudicial to … morality… or the integrity or independence of the judiciary of Pakistan, or which defames or brings into ridicule the judiciary or the Armed Forces of Pakistan.

The case for the prosecution is likely to proceed thus: ( 1) Article 62( d) applies because Mr Zardari is commonly known to be corrupt, hence his universal nickname as Mr 10 per cent. ( 2) Article 62( f) applies because he not ameen or sagacious or non- profligate because he broke

his pledge to restore the judges and repeal the 17th amendment. ( 3) Article 63( a) applies because he submitted a medical certificate to the Swiss Court some years ago saying his mind was disturbed and he couldn’t attend the proceedings.

THE Question Of Zardari Being A Good Muslim Will Have To Be Settled, One Way Or Another

THE CONFLICT between the Supreme Court of Pakistan and the government of President Asif Zardari is gathering momentum. Skirmishes have broken out on several fronts. And a make or break showdown is round the corner, unless the SC steps back — which may be desirable — or Mr Zardari throws in the towel — which is unlikely.

Maulvi Iqbal Haider, a maverick lawyer whose reputation as a puppeton- strings precedes him, has filed a petition with the Chief Election Commissioner ( CEC) asking him to reexamine President Asif Zardari’s qualifications to be a member of parliament in light of the National Reconciliation Ordinance ( NRO) judgment. The petition asks the CEC to investigate whether Mr Zardari was ever convicted under any circumstances at home or abroad or fulfils the constitutional requirement of being of sound mind or a good Muslim. Should Mr Zardari be guilty of either sin, he can be disqualified from being a member of parliament and his nomination as president of Pakistan can be held to be null and void.

The facts are slightly murky. The National Accountability Bureau ( NAB), which filed the cases of corruption against Mr Zardari during the regimes of Nawaz Sharif and Pervez Musharraf, says he was never convicted, in absentia or otherwise. The President’s spokesman insists likewise. But a section of the media and the bar reports otherwise. So we shall have to wait for the CEC to determine the facts of a case — avoiding 5 per cent import duty on an imported BMW car — that goes back to 2005. If the fact is that he was never convicted, he will be off the hook on this front.

THE war against extremism and terrorism in the NWFP and FATA is taking a significant turn. Three new developments are noteworthy. First, the Pakistan Army has finally taken the battle to Bajaur in South Waziristan where insurgents, militants and terrorists of all shades are said to be holed out. Over 500 Taliban and Al- Qaeda terrorists are reported to have been killed in recent days while others are said to have fled from the area. A ceasefire announced by the terrorists has been rejected by the military authorities who are encouraging thousands of refugees who fled the fighting earlier to return to their homes now.

Second, Rehman Malik, the advisor to the Interior Ministry, who is the chief anti- terrorism coordinator between the Army and the civilian governments in Islamabad and Peshawar, has articulated a new way of looking at the issue. He says that that the old policy distinction made by the Musharraf regime between the Afghan Taliban, the Pakistan Taliban, and the foreign Al- Qaeda fighters, is largely misplaced. His argument is that there is an unholy nexus between all three elements and both strategic and tactical policy against them should reflect an understanding of this network.

ZARDARI HAS FAILED TO TAME ISI

Zardari’s ostensible reason for clubbing IB and ISI under Rehman’s control together is “better coordination” of law and order and the war on terror. But this is really a euphemism for making the IB more efficient and simultaneously “taming” the ISI and “ bringing it into line”. In the PPP’s two previous stints in power, despite handpicked men to lead it, the IB had failed to warn Bhutto of her impending sacking at the hands of two presidents, a “hostile” one in Ghulam Ishaq Khan in 1990 and a “friendly” one in Farooq Leghari in 1996. In fact, the ISI’s role on both occasions was anti- prime minister. Under DG General Hameed Gul, it actually destabilised and then tried to overthrow her in 1989 and then helped rig the general elections to make Nawaz Sharif prime minister, while under DG General Naseem Rana in 1996, it became a handmaiden of the army chief, General Jehangir Karamat, when he approved her sacking by Leghari. So, notwithstanding the ISI’s non- interference in the general elections in 2008, which returned the PPP to power, Zardari’s obsession and fear of the ISI is not unjustified. Indeed, even before her assassination, Bhutto had pointed the finger at “ rogue elements” in the ISI and said they were out to get her.

OVER 400 people have been killed in gang and party political warfare in Karachi in the last two months. No permanent end to the senseless violence is in sight because of several factors.
The three- way struggle for turf and power in Karachi among the PPP, MQM and ANP overlaps with violent gang wars among the criminal drug, extortion, arms and land- grab mafias that have come to dominate the underworld of Karachi and established quid pro quo links with each of the three parties. The problem is that the PPP government is helpless to establish law and order because it cannot afford to launch any serious and sustained “clean- up” operation that targets and antagonises its provincial coalition partners whose support is needed to prop up its government in Islamabad.

PRESIDENT Asif Zardari is working overtime to stitch up his alliances so that his government can withstand any conspiracy, singly or in cahoots with one another, by the army or judiciary or the Pakistan Muslim League Nawaz or the Pakistan Tehreek Insaf to dethrone the PPP from Islamabad.
Maulana Fazal- ur- Rahman’s Jamiat- ul- Ulema- i- Islam is being appropriately appeased in the Senate and National Assembly, ditto Altaf Hussain’s Muttahida Quami Movement by amendments in the Local Bodies system in Karachi and Hyderabad, the Balochistan government by new packages of goodies and the Awami National Party by dragging Federally Administered Tribal Areas into the domain of the political parties.
